The Supreme Court has imposed a stay on the double murder case

The Supreme Court has imposed a stay on the direction of the Madras High Court to the Tamilnadu government to appoint a special officer or hand over probe to the CBI in the double murder at Ashok Nagar, Chennai.

It may be noted that the city police went on an appeal in the apex court against the direction stating that the court had overlooked many facts.
The police, in its appeal, further stated that the court observation that the investigation officer did not make any attempt to secure Senthil Kumaran who, according to Varadharajan, a fingerprint expert and private detective, was the real killer and that it had not recorded his statement was not correct.
Senthil was secured after a Tamil magazine published an article based on video clippings submitted by Varadharajan, giving a different twist to the murder case.
The investigating officer also secured Krishnakumar, who makes the statement on the video that it was his friend Senthil Kumar who murdered Ananthalakshmi and her son Suraj.
Ananthalakshmi and her son Suraj were murdered in their house in September last. Ashok Nagar police conducted the investigation and arrested four persons in connection with the crime.
While so, a bi-weekly magazine, published an article in its issue dated 18 October, 2009, stating that a compact disc (CD), giving more particulars about the murder, was handed over to the police officer concerned by a responsible person, but no action was taken on that.
Varadarajan submitted to the police that the CD contained the statement of another accused Krishnakumar giving more details about the murder.
The police contended that the statement given by Krishnakumar was fabricated, recorded only to give a twist to the murder case.
Varadarajan, an advocate, could not do private detective business. He also cannot interfere in the investigation which was already in progress.
The unwarranted act of Varadarajan had caused trouble to the investigating agency (IA) and marred the reputation of the police. This act should be considered as a serious offence and his custodial interrogation was necessary.
In his petition seeking advance bail, Varadarajan submitted that he had done so in good faith. It was not his intention to divert the investigation process.
It was only to help the police find out the real culprits. Instead of verifying the statement made by Krishnakumar, the police wanted to arrest the petitioner and harass him.
Following which bail was granted to him.
Refused to order a CBI probe into the alleged sex scandal case

The Madras High Court on Monday refused to order a CBI probe into the alleged sex scandal involving Swamy Nithyananda. It however reportedly lamented that fake godmen exploited gullible citizens and collected huge money through fraud.
Sri Nithya Dharmananda alias K Lenin, a devotee, had prayed the court to transfer the investigation on a complaint against Nithyananda dated March 4 this year pending before the Entrust Fraud Division of the City Central Crime Branch, to the CBI.
In his order, Justice R Regupathi said the occurrence alleged was admittedly committed in an ashram in Karnataka and for want of jurisdiction the case was transferred to that State. He observed that it was unfortunate that in spite of the teachings by great leaders, blind followers of fraudulent godmen could not be corrected.
Spurious and Expired drugs being seized from pharmaceutical dealers in CBI probe

With spurious and expired drugs being seized from pharmaceutical dealers in Tamil Nadu over the past few days, Chief Minister M.Karunanidhi Tuesday said the state government will seek a Central Bureau of Investigation (CBI) probe if such drugs are also found in other states.

Replying to the special call attention motion in the assembly on the issue, he said the investigation into the case has been transferred to the state police’s crime branch as it was found the case has links to several cities in the state as well as connections outside the state.
‘If it is found such spurious and fake drug sales are happening in other states, we will not hesitate to ask of a CBI investigation in the case,’ Karunanidhi said.
He urged the media to be cautious while reporting about the case so that panic is not created in the minds of the people.
Members belonging to various political parties participated in the debate.
There are 539 drug units in Tamil Nadu and 42,500 retail and wholesale drug trades. In the last few days, state police and health authorities raided pharmaceutical shops and dealers and seized a large quantities of expired drugs.
Fearing prosecution, many dealers and drug retailers are dumping the expired drugs on the roads across the state.
Meanwhile, Meenakshi Sundaram, promoter of Meena Healthcare, and the prime suspect in the recirculation of the expired drugs, has surrendered.
The crime branch has set up special teams to deal with the case.

The Tamil Nadu government is likely to convey its decision today on Rajiv Gandhi’s assassin Nalini Sriharan’s plea for pre-mature release.

Earlier this month the state government had submitted the Prison Advisory Board’s report on this to the Madras High Court and sought two weeks time to gather additional information on her.
The Board has reportedly given a favourable report.
Nalini’s death sentence for her role in the assassination of former Prime Minister Rajiv Gandhi was commuted to life and she has spent 19 years behind bars. She has challenged the Tamil Nadu government’s refusal to grant her general amnesty on the ground that her case came under the CBI.
Triple murder case in Ashok Nagar to transfer the CB CID
The Madras High Court on Monday said it was of the view that if the Chennai Police is not able to solve a triple murder case in Ashok Nagar within four weeks, the Commissioner of Police will request the State Government to transfer the case to the CB CID.

The crime relates to the murder of Saravanan, his wife Kasturi and a female domestic worker , Anbarasi, in November 2008.
The First Bench comprising Chief Justice H.L. Gokhale and Justice K.K. Sasidharan passed the order while disposing of a petition by S.D.S. Rajadhevan, a city advocate. The petition had been filed in public interest to bring to light the number of murders that had occurred in Ashok Nagar here.
The petitioner, a retired Superintendent of Police, CB CID, said as a resident of Ashok Nagar he was rudely shocked and affected seeing the sorry state-of-affairs of the police, particularly in the investigation of murder cases which remained unresolved.
Despite the infrastructure and manpower, the police were unable to put in their best to protect the public and bring the culprits to book immediately. There was little or no coordination, supervision or detection of property cases and grave crimes.
His main prayer was a direction to the authorities to transfer all the murder cases of Chennai Police for further investigation by CB CID or CBI so as to ensure proper investigation and to restore public confidence.
The Government Pleader had earlier filed a report pointing out how security arrangements in the locality (Ashok Nagar) had been enhanced.
It was also stated that though there were 19 murders in the area since 2008, 18 had been promptly detected. It was only one case of triple murder which remained unsolved.

The Commissioner of Police in his affidavit submitted that 10 special teams had been formed to look into the case and it was hoped that investigation would move towards its logical conclusion and that the accused would be arrested.
On the prayer to transfer the case to CB CID, it was stated in the counter that if there was any difficulty in solving the case, the Commissioner would not hesitate to request the government to hand over the case to CB CID.
The Bench said, however, no time limit had been specified for completing this exercise. It was quite natural it would be difficult to specify any time limit in this regard. At the same time, there was justification in the petitioner’s anxiety for early action. The triple murder case had remained unresolved for more than a year now.
The court said the petitioner may assist the authorities in the matter of investigation of the case.
CBI filed the chargesheet accusing 31 advocates, a law student & 5 police personnel

A week after the Central Bureau of Investigation (CBI) filed a chargesheet in connection with the bloody clash between police and advocates on the Madras High Court premises in February last year a Magisteral Court today commenced the trial, even as advocates lodged their protest, stating it was a ‘defective chargesheet’.

After the CBI filed the chargesheet on January 12, accusing 31 advocates, a law college student and five police personnel, the Additional Chief Metropolitan Magistrate Killivalvan took cognisance of the same and commenced trial, amid protest by the advocates.
When the case came up for hearing, the Madras High Court Advocates Association and Tamil Nadu Advocates Association filed petitions stating that the chargesheet was one-sided and the Court should not accept it.
The Magistrate ordred issuance of notice to the CBI and adjourned the case for tomorrow.
Madras High Court Advocates Association President R C Paul Kanagaraj, appearing before the court on behalf of the accused laweyrs, said the CBI had filed the chargesheet without proper investigation.
It was a defective chargesheet as the investigating agency had not conducted proper investigation before arraigning 31 advocates in the case, he said and pointed out that the CBI had accused only five police personnel, while requesting departmental action against 22 police personnel.
If departmental action was recommended against the 22 other policemen, it meant they erred in their duty and in that case, why they were not included as accused in the chargesheet, Mr Kanagaraj asked.
When the CBI itself said they committed excesses, why they were not included as accused, he also contended.

The Central Bureau of Investigation on Tuesday filed charge sheets in the case pertaining to violent incidents on the Madras High Court campus here on February 19, 2009.
According to sources in the agency, charge sheets were filed against 31 advocates, about 10 police personnel and one Law College student under various provisions of the IPC and Tamil Nadu Property (Prevention of Damage and Loss) Act, 1992. Departmental action was recommended against 22 police personnel.
The CBI made no comments on the role, conduct and culpability of former Chennai Police Commissioner, K. Radhakrishnan, former Additional Commissioner of Police (Law and Order) A.K. Viswanathan, former Joint Commissioner of Police (North) M. Ramasubramaniam and former Deputy Commissioner of Police (Flower Bazaar) Prem Anand Sinha, as the matter was pending in the Supreme Court.
The case pertains to the clash between police and advocates on the Madras High Court premises in which many advocates, police personnel, journalists and one High Court Judge Arumuga Perumal Adityan were injured. A police station and scores of vehicles were damaged in fire and pelting of stones.
The Madras High Court ordered a probe by the CBI in the case. A Special Investigation Team (SIT) was constituted by the CBI Director to investigate the cases. The agency filed six charge sheets in the Court of Additional Chief Metropolitan Magistrate, Chennai.
During investigation, the SIT interviewed two Madras High Court Judges and examined 653 persons, including 197 advocates, 245 policemen, 81 court staff members and 27 persons from the media. Original recordings relating to the incidents were arranged from television channels and sent for forensic examination to ascertain authentication.
The guidance of the retired Supreme Court Judge B.N. Srikrishna was sought by the CBI during investigation and for finalising its recommendations. On the basis of material evidence collected during the investigation, the charge sheets were filed.
The charges against the police and advocates include offences of criminal conspiracy, rioting, unlawful assembly, causing simple/grievous hurt, causing simple/grievous hurt to deter the public servant from discharge of his duty, mischief by fire, criminal trespass in order to commit offence and causing damage to public/private properties,
Officials of the CBI surprise raids in NHAI office

Officials of the CBI conducted surprise raids in the offices of the National Highways Authority of India (NHAI) and registered criminal cases against a senior official on charges of graft.
CBI sources said, acting on complaints that the NHAI officials were showing undue favours to private firms in awarding some contracts after getting bribes, special CBI teams conducted a raid at NHAI office at Guindy and at the office of its Chief General Manager Shyam Singh Singhvi.
The raids which began last evening was still continuing and several incriminating documents were seized during the search operations.
Simultaneous raids were also carried at the Mr Singhvi’s residence in Rajasthan.
The raids at Chennai and Jaipur residences of Mr Singhvi and at his office yielded several lakhs of unaccounted cash, gold jewellery and various incriminating documents, including those pertaining to purchase of property in various parts of the country.
Apart from seizing several documents, the CBI officials found several irregularities in awarding of contracts to private firms, following which cases of criminal misconduct were registered against Mr Singhvi.
Some official files were also seized from Mr Singhvi’s residence in the city, the sources said.
Cases under Prevention of Corruption Act were also regsitered agaisnt him.
CBI surprise raids at the International Air Cargo complex and arrested eight customs officials
Sleuths of Central Bureau of Investigation (CBI) conducted surprise raids at the International Air Cargo complex near the airport and arrested eight customs officials, here this morning.
Acting on complaints of several irregularities in validating the costs while clearing imported cargo, five special teams from the CBI conducted the searches and arrested three Superintendents and four Inspectors of the Customs department, besides an assistant working in the air cargo complex.
The CBI officials also seized Rs 16 lakh unaccounted cash, which was allegedly received as bribe for clearing the cargo.
The raids, which began last evening, was still continuing, CBI sources told UNI.
During the raids, all the documents pertaining to arrival and despatch of Cargo came under the CBI scanner.
The officials also had a close look at the customs clearance documents and found that customs officials had quoted less value for the cargo that arrived from abroad and collected the balance amount as bribes.
CBI team conducted raids on two chemical companies
A CBI team conducted raids on two chemical companies, which are alleged to have misused subsidised fertilizer for industrial purposes, at Nedungadu near here on Tuesday. The raids followed the CBI investigation that Karaikal Chlorates and Vaigai Industries were manufacturing potassium chlorate after acquiring subsidised potassium chloride. The CBI team seized documents, which could provide information on suppliers and other agencies that received the raw material from Indian Potassium Limited, the authorised agency for the import of potassium chloride. Information was also being collected whether the potassium chlorate was being diverted for illegal activities.
