Mohammad Ajmal Amir Kasab “shall be hanged by neck till he is dead.”

Mohammad Ajmal Amir Kasab “shall be hanged by neck till he is dead.” These crucial words were pronounced by the Special Sessions Court in Mumbai on Thursday, while sentencing to death the lone surviving gunman of the November 26, 2008 Mumbai terror attacks.

Kasab was given the death penalty on five counts: murder, abetment to murder, waging war, criminal conspiracy and committing terrorist acts. He was also awarded life imprisonment on five counts: attempt to murder in furtherance of a common intention, kidnapping and abducting in order to murder, conspiracy to wage war, collecting arms with the intention of waging war and causing explosion thus endangering life and property.
“Aapko char offences ke liye sazaye maut di jaati hai,” Judge M L Tahaliyani told Kasab after he read out the order. “You have been given the death penalty for murdering Indian citizens, police officers, conspiring with Lashkar leaders and committing terrorist acts. The court has said while giving the judgment that you shall be hanged unto death,” Tahaliyani told Kasab.
The Indian Penal Code Sections under which Kasab has been given death penalty are: 302 (murder), 302 read with 120 B (criminal conspiracy), 121 (waging war), 302 read with 34 (common intention) and 302 read with 109 (abetment) read with 120 B.
In addition, he has been given death for the offence punishable under Section 16 of the Unlawful Activities (Prevention) Act. For the other offences, he was awarded rigorous imprisonment, simple imprisonment and imposed with fines.
The special sessions court in its reasoning for the sentence stated: “There is no evidence of mental or emotional disturbance. On the contrary, he appeared to be mentally prepared. The court has taken note that this man voluntarily went to the office of the Lashkar-e-Taiba. No leader took him there. He along with his friend Muzaffar went from place to place without being accompanied by anybody. He offered to become a mujahid. He was prepared to face all kinds of training. He refused the option of returning to his relatives’ place and preferred to [remain at the training. There is no chance of reformation or rehabilitation of such a person. The way he has committed the offence gives the court no scope for considering his reformation or rehabilitation.”
In agreement with the prosecution's argument of unimaginable brutality, the court noted, “[The memory of] brutality was writ large on the faces of the witnesses. When you read the evidence of witnesses at CST [Chhatrapati Shivaji Terminus], see the photographs of [photographer] Sebastian D’Souza, I don’t think any words are required to describe the brutality. Some witnesses were not even ready to be police witnesses although having seen the incident, and some were not ready to come to court although their statement had been recorded by the police.”
Commenting on the incident, Mr. Tahaliyani said, “There are no words to explain the exceptional depravity seen in the initial stages of commission of offence. When he fired indiscriminately, it was without any regard; children and women were killed.”
Meanwhile, Union Law Minister M Veerappa Moily on Thursday said the verdict in the 26/11 case was a message to Pakistan that it cannot meddle in India’s affairs and to terrorists that they would face the same fate as Mohammad Ajmal Amir Kasab.
Speaking to reporters, he said, “Pakistan cannot meddle with the lives and properties of [our people] and if any terrorist is encouraged by them, he will meet the same fate as Kasab. The verdict sends a message to all terrorists — you land in India and you will meet the same fate.”
Police have arrested Killers of rowdy, his advocate

Chennai suburban police have arrested four persons in the murder of a notorious rowdy and his advocate near the Poonamallee Court complex recently.
The rowdy Chenna alias Chennakesavalu and his advocate were hacked to death by a 10-member gang while he was having lunch in his car near the court complex where he had come for a trial in an explosives case on 30 April.
Speaking to reporters today, Suburban Police Commissioner S R Jangid said six special teams, formed to catch the culprits, apprehended the four near suburban Parivakkam. Interrogations with them revealed that they were associates of rowdy ‘Arcot’ Suresh, key accused in a murder case.
The murder was a fallout of a personal enmity between ‘Arcot’ Suresh and Chenna, he said and added that the duo had constant trouble for more than 15 years since the former’s wife Anjalai eloped with Chenna.
The Commissioner said that over 21 persons were involved in the whole murder plan however only nine of them were present on the scene of crime. ‘We are on the lookout for 17 more persons who were involved in the crime. We have seized a motorcycle, a car and three sickles from the accused,’ he said.
The arrested were Velmurugan (24) of Nandambakkam, Rakesh (24) of K K Nagar, Satheesh (23) of Kunrathur and Raji (23) of Nandambakkam.
Chenna was residing in Chennai for the past 18 years and set up a gas agency at Pulianthope, he said and added that Chenna was arrested by the police in about 23 criminal offences, most of which ended in acquittal.
He was involved in the murder case of one Vijayakumar in Egmore Court in year 1996 and two other murder case in 2006. He was detained under the Goondas Act in 1994, 1996 and 2003.
‘Arcot’ Suresh was an accused in the murder case of one Srinivasan in Vijayawada in 2002 and Paramasivam of Kancheepuram.
Actress Ranjitha silence and denied relationship with godman Nithyananda

Tamil film actress Ranjitha on Thursday finally broke her silence and denied ever having any kind of relationship with the tainted self-proclaimed godman Nithyananda.

She also dissociated herself from the video clippings aired by some private TV channels alleging that the woman shown in intimate positions with the Swami in the footage is Ranjitha.
Her lawyers from PM Law Chambers (PMLC), New Delhi, released a statement on her behalf stating that, “Our client strongly objects to being referred to as one of the persons in the video. The said imputation by anyone is causing unnecessary loss of reputation, mental harassment, agony, loss of earnings, which are all actionable wrongs.”
“Our client dissociates herself from the said video which has caused danger to her life, limb and property,” further added PMLC.
PMLC also said that the actress has never given any interview in media regarding this scandal before and had not been questioned by Bangalore CID either.
Legal notice asks Google to remove “malicious” video clippings
On behalf of actress, PMLC also issued notices to the search giant Google Inc. and its subsidiary YouTube to remove the video clippings from the websites or else face legal charges.

“We have asked them to remove the controversial video clippings from the websites by May 2, failing which we will file charges against them under the Indian Penal Code and the Information Technology Act,” said Ranjitha’s lawyer.
“The video clips, which clearly amount to gross violation of various laws of India, have malicious, diabolical and destructive intent, and are clearly aimed at bringing harm to the actress,” added lawyer.
Actress’ body double used to defame her in the video
Ranjitha’s lawyer gave a new twist to the whole drama on Thursday by stating that it’s possible that the videotape was shot with help of a “body double” of Ranjitha.
“My client is not a devotee of Nithyananda but has met him. The allegations that she has signed the non-disclosure agreements are false and malicious. It is not Ranjitha in the tape. The entire tape is edited and will not stand as evidence in a court of law,”
Jayalalithaa’s plea for contentions and dismissed her petition

Ms. Jayalalithaa had made the plea on the ground that investigation conducted by Tamil Nadu police during the year 1996—97, was “not in accordance with law“.
In his order, Judge B M Malliarjunaiah rejected her contentions and dismissed her petition.
The case will come up for next hearing on May three.
The Supreme Court on March 19 had declined to stay the trial against her in the 14 year-old disproportionate assets case.
Convocation Function conducted in Kundavai Nachiyar Government Arts College

Delivering the convocation address at Kundavai Nachiyar Government Arts College for Women, Mr. Pannerselvam said that law enforced by government can help to some extent to keep people away from drinking. But besides law and government women can put an end to drinking liquor and ensure total prohibition in the State.
Moreover, he said that degrees gained by the students are not easily earned. Parents and teachers played a major role in making them graduates. The students should not forget this.
He distributed degrees to 738 graduates, 229 post graduates and 20 M. Phil students in the convocation. R. Devaki, Principal of the college participated.
Ranjitha, Lenin Karuppa attempted to blackmail together to trap Swami Nithyananda
Ranjitha, who recently got alleged with Swami Nithyananda in a sex scandal, is said to have attempted for a suicide. The scandal video was aired by the popular Tamil channel Sun TV on March 2. No news of either of the two was known thereafter. People were so angry and desperate that they attacked the ashrams of Swamiji.

Ranjitha was a devotee to Swamiji. She was a divorcee to an army man and visited Nithyananda after suffering from depression due to the marriage failure. Later she became too close to Nithyananda that she made her presence all the time in the ashram. Buzz is also that the video was created by Ranjitha herself to blackmail Nithyananda. She wanted a married life with Nithyananda and is said that this possessiveness made her to trap Nithyananda.
Ranjitha was introduced to him three years back by actress K R Vijaya’s niece Sudha, a full-time devotee. Later on Swami’s charm made her fall for him and she even decided to shift base from Chennai to Bangalore. After getting intimate with Swami, she is said to have asked him to marry her and even got a positive response. Later he was worried about the property worth several hundred crore rupees that he would have to give up. Lenin Karuppa also attempted to blackmail Swamiji but he failed. So it is said that both have planned together to trap Swami Nithyananda.
By the time Nithyananda’s lawyer confirmed that Nithyananda is in Varanasi attending Kumbha Mela with his 4000 devotees. He is to return back on March 18. He also claimed that the woman in the video has covered her neck and that Nithyananda’s face is a morphed one.
First-year Law students alleged iron rods and hockey sticks by Ragging some seniors

A first-year student of the government Law college here has alleged that he was beaten up with iron rods and hockey sticks by some seniors while being ragged.

According to the complaint by Naveen Kumar, eight second and third-year students, waylaid him last night near the college on the city outskirts and beat him up, police said.
Based on the complaint, police registered a case against the eight under the section of 147 (unlawful assembly), 294 B (beating with weapons) and 324 (using abusing language) and also under Tamil Nadu Prevention of Ragging Act.
To prevent any untoward incident, adequate number of police have been deployed near the college.
Lawyers in Tamil Nadu will boycott court proceedings on February 19

Lawyers in Tamil Nadu will boycott court proceedings on February 19 to protest “failure” of the state government in taking action against police officers held responsible for the violence in the Madras high court premises a year ago.

The decision was taken today at a meeting of the Joint Action Committee representing various advocates associations, including Madras high court Advocates’ Association (MHAA), Tamil Nadu Advocates Association, Bar Council of Tamil Nadu and Puducherry and Womens’ Lawyers Association.
MHAA president RC Paul Kanagaraj said in a statement that “members of the legal fraternity will abstain from all courts in Tamil Nadu on February 19 and will forma ‘human chain’. The day will be observed as ‘black’ day and advocates will wear black shirts.”
The CBI had last month filed a chargesheet against four police personnel and 32 advocates in a city court and recommended departmental action against 22 policemen in the case regarding the lawyers-police clash in the Madras high court complex on February 19 last year.

India’s Supreme Court ruled yesterday that unmarried couples have the right to live together after hearing a case involving a Tamil actress accused of corrupting young minds by promoting premarital sex.

The judges pointed out that even the Hindu gods, Lord Krishna and Radha, were co-habiting lovers rather than man and wife. “When two adult people want to live together, what is the offence?” they said. “Living together is not an offence. Living together is a right to life.”
The ruling marks a legal milestone in India’s sexual revolution as younger members of the urban professional classes slowly but steadily break down traditional taboos.
It is unlikely, however, to change habits among most Indians, who rarely indulge in premarital sex, let alone cohabit with lovers, and usually have their spouses chosen by their parents.
The actress, who goes by the single name of Khushboo, had appealed to the court to quash more than 20 cases filed against her in 2005 after she made allegedly immoral comments in magazine interviews. She told one publication that “no educated man would expect his [bride] to be a virgin”. The comments led to outrage in parts of southern India, where she is a star of Tamil-language movies.
The judges, however, challenged lawyers acting for the complainants to produce evidence of any girl running away with a lover in response to Khushboo’s comments. “Please tell us what is the offence and under which section should she be charged? Tell me how many people have been affected by Kushboo’s statement?” asked Chief Justice K. G. Balakrishnan.
Khushboo, 39, took her fight to the Supreme Court after a court in Madras dismissed her 2008 plea for it to quash the criminal cases filed against her.
The Indian Government does not provide statistics for unmarried couples cohabiting but a study by the Mumbai-based International Institute for Population Sciences last month showed that 17 per cent of young men in rural areas said that they had had premarital sex, compared with 10 per cent in urban areas.
The survey of 55,000 women and men aged 15-29 also showed that 4 per cent of women in rural areas claimed to have had premarital sex, compared with 2 per cent in the cities.
